Representing clients in insurance matters and coverage litigation has been a cornerstone of German, Gallagher & Murtagh's practice since its foundation. Our extensive experience in all phases and areas of insurance law includes coverage litigation, reinsurance litigation and arbitration, bad faith litigation, as well as providing advice and opinions on a variety of coverage matters. Our clients cover the entire insurance spectrum from primary carriers to excess carriers and reinsurers. We have provided advice and represented insurers in a wide variety of matters involving errors and omissions policies, primary and excess commercial general liability policies, school leaders policies, claims made and occurrence policies, homeowners policies, and automobile policies.
Our firm has served as national coverage counsel and currently serves as regional counsel for a carrier in complex environmental coverage litigation. We have pursued numerous declaratory judgment actions, both in the state and in the federal systems, in order to resolve coverage disputes. Issues and coverage terms that have been analyzed include advertising injury coverage and violations of antitrust laws and patent infringement, personal injury coverage and wrongful eviction and malicious prosecution, exclusions for employment-related claims, exclusions for sexual abuse, recoverability of punitive damages, violations of the Unfair Insurance Practices Act and bad faith, and trigger of coverage and allocation of damages.
