Defense Verdict in Traumatic Leg Amputation Case

Gary Gremminger recently obtained a defense verdict in a jury trial held in Philadelphia County. Plaintiff was operating a dirt bike when he was involved in a collision with defendant’s motor vehicle. Plaintiff’s leg was severed above the knee.

Plaintiff presented testimony by an accident reconstruction expert to support his theory of liability but the expert opinion was trumped by the testimony of an independent witness and also by that of the investigating police officer who took a statement from the plaintiff at the hospital a week after the accident.  Plaintiff’s claim that the statement was given while he was under the influence of narcotic pain medication was apparently rejected by the jury which found the plaintiff to be 80% at fault.
